Voyage+ Operator Terms

These Operator Terms (the "Terms") are an agreement between PT The Luxury Leisure Internasional, which provides the Voyage+ platform ("Voyage+"), and the company or person that registers an operator account and operates the vessels listed in it (the "Operator").

The Terms take effect when an authorised representative of the Operator accepts them — when the account is created, or when the console first asks — and apply for as long as the Operator uses Voyage+. The Data Processing Agreement forms part of these Terms. Together they are the whole agreement between the parties about Voyage+, unless the parties agree otherwise in writing.

1. Definitions

1.1"Console" means the Voyage+ operator console and the crew app; "Account" means the Operator's organisation on it, together with its users.

1.2"Vessel" means each boat or yacht the Operator lists on Voyage+.

1.3"Guest" means a person who enquires about, books or sails on a charter of a Vessel.

1.4"Direct Booking" means an enquiry or booking that reaches the Operator through its own channels on Voyage+: its booking page (including on its own domain), the booking widget on its website, the Console, or a travel agency the Operator invites to the agent portal.

4. Fees

4.1A new Account starts with a free trial. Its length is shown in the Console when the Account is created, or agreed in writing with Voyage+. Nothing is charged automatically, during the trial or when it ends.

4.2After the trial, the Operator pays a Listing Fee per Vessel per month, according to the Vessel's type and the billing it chooses — monthly or yearly — at the price list Voyage+ publishes and shows in the Console, unless a different price is agreed in writing.

4.3Voyage+ charges no commission on Direct Bookings. The only other charges are: the commission on Desk Bookings under section 5, only if the Operator chooses to list a Vessel with the YH Charter desk; and the fee for an optional add-on the Operator orders in writing, such as sending its email from its own domain, at the price agreed in writing when it is ordered. An add-on fee is invoiced and payable as Listing Fees are under clause 4.4. The Operator may stop an add-on at any time by telling Voyage+; a fee already invoiced is not refunded.

4.4Listing Fees are invoiced in advance — each month on monthly billing, or once for twelve months on yearly billing — and are payable within 14 days of the invoice date. They exclude tax; where Voyage+ must charge a tax on them, such as value added tax (PPN), it is added to the invoice at the rate the law sets.

4.5A change to the price list is announced at least 30 days before it applies to the Operator.

4.6Voyage+ emails the Operator seven days and one day before a trial ends. If a trial ends without a plan being agreed, or a Listing Fee is overdue and remains unpaid at least seven days after Voyage+ has reminded the Operator by email, Voyage+ may pause the two services it performs for the Operator in public: the booking widget and booking page stop taking new requests, and any Vessel listed with the YH Charter desk is withdrawn from its marketplace. The Console, Vessels, rates, bookings and Guest data remain available to the Operator, nothing is deleted, and what was paused is restored once a plan is agreed or the fee is paid.

4.7Yearly billing starts once Voyage+ confirms it to the Operator in writing, email included, and covers the twelve months the invoice names. The yearly price does not change during those twelve months, including under clause 4.5. A yearly period does not renew by itself: before it ends, the Operator chooses yearly or monthly billing for what follows, and until the Operator chooses, monthly billing applies at the price list then in force.
